A will gives you control over what happens to your estate when you die. Without a will, those whom you intended to benefit from your estate may not.
Putting off completing a will can have unintended and serious consequences on both your financial affairs and family members. For example, a will is the only legally binding way of appointing guardians to look after children, should both parents die while the children are still under the age of 18. Lasting Powers of Attorney (LPAs) are legal documents that are used whilst you’re still alive.
With LPAs in place, people that you know and trust, your attorneys, can pay your essential bills if you have to go into hospital, for example. They can also make medical and care-related decisions, which can be life-changing in the case of people with dementia.
Since an LPA can only be registered if the person using it (‘the donor’) still has mental capacity, it’s important to get them in place as soon as possible. Without an LPA, you would have to go to court, and that could be very expensive and costly.
