Will Writing

A will gives you control over what happens to your estate when you die. Without a will, those whom you intended to benefit from your estate may not.

Putting off completing a will can have unintended and serious consequences on both your financial affairs and family members. For example, a will is the only legally binding way of appointing guardians to look after children, should both parents die while the children are still under the age of 18. It is not a matter of course that they will be placed with family members, it is for a court to decide, and that can be time-consuming, costly and, more importantly, distressing. Probate, another area that we can assist with, is also more likely to be more costly.

 

Lasting Powers of Attorney (LPAs)

Lasting Powers of Attorney (LPAs) are legal documents that are used whilst you’re still alive.

With LPAs in place, people that you know and trust, your attorneys, can pay your essential bills if you have to go into hospital, for example. They can also make medical and care-related decisions, which can be life-changing in the case of people with dementia.

Since an LPA can only be registered if the person using it (‘the donor’) still has mental capacity, it’s important to get them in place as soon as possible. Without an LPA, you would have to go to court, and that could be very expensive and costly.

 

Funeral Plans

Funeral costs have more than doubled in the last 14 years, and the cost could easily exceed £10,000 a decade from now. That’s why pre-paid funeral plans are a good idea because they allow you to pay for a funeral at today’s prices. The longer you live, the more you save.

When you pass away, the funds are then paid to a local funeral director who will arrange your funeral as per your wishes. Assets held in trust are owned by the trustees – the people you appoint – for the benefit of the beneficiaries. If you’re concerned about passing a house or money to a child who may be vulnerable now or in the future, a trust is ideal.

Trusts also prevent children from losing half of their assets if they get divorced, or all of their assets if they go bankrupt. They ensure that children won’t be disinherited if a surviving partner gets remarried. And they can ring-fence a home to protect it against being sold to pay for care fees.

Future generations will also benefit because they won’t directly inherit the assets, significantly reducing their inheritance tax bills.
