A will gives you control over what happens to your estate when you die. Without a will, unmarried partners and stepchildren won’t benefit from your estate.
A will is also the only legally binding way of appointing guardians to look after children should both parents die while the children are still under the age of 18. Otherwise, a court would decide who brings them up. Probate can also be far more time-consuming and, for complex estates, a lot more expensive.
Lasting powers of attorney (LPAs)
Not to be confused with wills, lasting powers of attorney (LPAs) are legal documents that are used whilst you’re still alive. They allow trusted people of your choosing, called attorneys, to act on your behalf to access your bank accounts or sell your home.
With LPAs in place, your attorneys can pay your essential bills if you have to go into hospital, for example. They can also make medical and care-related decisions, which can be life-changing in the case of people with dementia.
Since an LPA can only be registered if the person using it (‘the donor’) still has mental capacity, it’s important to get them in place as soon as possible. Without an LPA, you would have to go to court and that could be very expensive and costly.
It’s a sad fact that you have to pay for your own funeral – it’s taken from your estate after death. But funeral costs have more than doubled in the last 14 years.
The cost could easily exceed £10,000 a decade from now. That’s why pre-paid funeral plans are a good idea because they allow you to pay for a funeral at today’s prices.
When you pass away, the funds are paid to a local funeral director to arrange the funeral. Your family will therefore inherit a bigger estate.

The future is uncertain – we can’t predict it, so there’s simply no way of knowing what’s going to happen. That’s where trusts come in.
Whilst a will gives your beneficiaries gifts outright, a trust is like a gift with strings attached. Assets held in trust are owned by the trustees – the people you appoint – for the benefit of the beneficiaries. If you’re concerned about passing a house or money to a child who may be vulnerable now or in the future, a trust is ideal.
Trusts also prevent children from losing half of their assets if they get divorced, or all of their assets if they go bankrupt. They ensure that children won’t be disinherited if a surviving partner gets remarried. And they can ring-fence a home to protect it against being sold to pay for care fees.
Future generations will also benefit because they won’t directly inherit the assets, significantly reducing their inheritance tax bills.
